Terms of Use for the Driex app

1. Scope
These terms govern the use of the iOS app "Driex" by Ben Dürringer (Steinenbühl 7, 72336 Balingen, Germany). Apple's standard licence agreement (EULA) for App Store apps applies in addition.
2. Road safety first!
Driex is designed as a pure audio companion while driving. Never operate the app while driving; change settings only while the vehicle is stationary, or use CarPlay. You alone are responsible for driving your vehicle safely; road traffic law always takes precedence.
3. Importing your own music (private copy)
Import is intended exclusively for music you lawfully own (e.g. purchased files) — within the limits of the private-copy rules (Section 53 of the German Copyright Act, UrhG). Importing files from obviously unlawful sources, circumventing copy protection (DRM) and any passing on of the processed versions to third parties are prohibited. The processed stems are intended for your private use within Driex only. You are responsible for the lawfulness of your imported content.
4. Catalog content (Driex Radio)
The songs of the Driex catalog are AI-generated productions (artist: "Driex") and are licensed to you for private playback within the app — for the duration of your active access (Radio subscription). Export, redistribution or any other use outside the app is not permitted.
5. Purchases and subscriptions
Driex Pro is a one-time purchase. Driex Radio is an auto-renewing subscription (monthly or yearly); the price is shown before purchase and billed via your App Store account. The subscription renews automatically unless cancelled at least 24 hours before the end of the current period. You can manage and cancel it at any time in your device's App Store settings. After cancellation, access continues until the end of the paid period.
5a. Refer a friend (bonus programme)
In the app you can share a personal referral code. If a new user takes out a yearly Radio subscription with your code, both of you receive 30 bonus days of Driex Radio and an additional vibe. A purchase with a referral code comes without a free trial period; this is clearly stated before purchase. Bonus days have no monetary value and are neither paid out nor transferable; without an active subscription they unlock Radio access directly, with an active subscription they attach to its end. At most three referrals per user are rewarded. If the referred subscription is refunded or revoked, the associated benefits lapse for both sides; bonus time already used remains unaffected. In case of abuse (e.g. self-referral, technical manipulation) we may revoke benefits and exclude users from participation. We may change or discontinue the programme with effect for the future at any time; bonus days already credited remain valid. Your statutory right of withdrawal remains unaffected.
6. Availability
Cloud features (catalog, server import) require an internet connection. We strive for high availability but do not guarantee it; during outages the local feature set remains available.
7. Liability
We are liable without limitation for intent and gross negligence and under the German Product Liability Act. In cases of slight negligence we are liable only for the breach of essential contractual obligations and limited to the foreseeable damage typical of the contract. For damage resulting from injury to life, body or health, the statutory rules apply.
8. Discontinuation of the service
We may discontinue the operation of Driex and the cloud infrastructure it uses (server import, Driex Radio). We will announce a permanent discontinuation in the app at least three months in advance. Songs already imported and stored locally on your device remain usable; cloud-dependent features will no longer be available afterwards. In this case there is no right to a refund of the Pro one-time purchase, as the app remains usable with the locally stored songs. A Driex Radio subscription running at that time will be cancelled by us at the end of the notice period; prepaid but unused subscription time will be refunded pro rata.
9. Changes
We may amend these terms with effect for the future when features or the legal situation change. We will announce material changes in the app.
10. Final provisions
German law applies. Mandatory consumer-protection provisions of the state in which you have your habitual residence remain unaffected. These terms are available in German and English; in case of discrepancies, the German version prevails.
